1. Who we are
PayAndes is a software service operated from Peru. It includes the payandes.com website and its subdomains (such as account.payandes.com and pay.payandes.com), the merchant dashboard, the payment page (checkout), the API, the integration modules and the Telegram bot (together, the "Service").

2. What PayAndes is and is not
PayAndes is a technology tool: it connects your online store with payment methods (Binance Pay, USDT on the TRC20 and BEP20 networks, and Yape) and automatically verifies that your customer's payment reached your own accounts, so the order is confirmed on its own.
PayAndes is not a bank, a financial institution, an exchange, a wallet, a payment processor or an intermediary. It does not receive, hold, transfer or retain money or crypto assets: funds go directly from your customer to your accounts.
PayAndes is not a party to the purchases and sales between you and your customers, does not sell your products and does not guarantee your transactions.
Binance, the TRON and BNB Smart Chain networks, Yape and Telegram are third-party services, independent from PayAndes and with their own terms, which you accept directly with them.
3. Your account and its security
- You must be over 18, have legal capacity and give us true and up-to-date information.
- You are responsible for your password, your two-step verification, your API keys and your gateway keys, and for everything done with them, even if someone else does it.
- The keys you register to verify payments (for example, the Binance API) must be read-only. Never enable withdrawal or trading permissions.
- PayAndes will never ask for your password or your keys by chat, phone or email.
- Tell us right away if you think someone used your account without permission.
We may ask for reasonable information to verify your identity or activity when needed for the security of the Service.
4. Plans, payments and renewal
- The Service is offered as a subscription plan. The current price is the one published on the website (today, $50 USD per year) or the one an authorized reseller gives you.
- PayAndes charges no per-transaction fees. Third-party fees (blockchain networks, Binance, Yape, banks, exchanges or others) and any taxes on your payments are paid by you or your customers.
- The plan covers the period purchased. When it expires, your account stops accepting new orders until you renew it. There are no automatic charges.
- Because the plan includes activating and setting up your account, the payment is not refundable once the account is activated, unless applicable law says otherwise or PayAndes cannot provide the Service for reasons attributable to PayAndes.
- We may change prices. Changes apply from your next renewal and we will tell you in advance.
5. Authorized resellers
You can buy your plan directly from PayAndes or from an authorized reseller listed in the official directory.
- Resellers are businesses independent from PayAndes: they set their prices, the payment methods of their country, their timing and their support, and they handle the activation of your account with you.
- PayAndes only recognizes as resellers those listed in the official directory. Before paying, verify their Telegram or WhatsApp on that page.
- What you pay a reseller, what you agree with them and any claim about that payment are settled directly with the reseller. PayAndes does not receive that money and is not responsible for promises, discounts or extra services a reseller offers.
- A payment made to someone who is not in the directory is not a payment to PayAndes or to an authorized reseller, and PayAndes is not responsible for it.
- Resellers must follow these Terms and their agreement with PayAndes. PayAndes may remove any reseller from the directory.
6. Permitted and prohibited use
You agree to use the Service only for legal sales and to follow the laws that apply to you, such as consumer protection, tax and anti-money-laundering laws. You may not use the Service to:
- sell products or services that are illegal, counterfeit or infringe the rights of others;
- unlock or tamper with stolen, lost or reported devices, or offer services that make fraud easier;
- launder money, finance terrorism, evade sanctions or run scams;
- offer unlicensed gambling or betting, weapons, drugs, sexual content involving minors or other prohibited goods or services;
- impersonate PayAndes, another merchant or a reseller;
- attack or overload the Service, look for vulnerabilities without permission, get around its limits, copy or reverse engineer it, or access other people's accounts;
- resell the Service without being an authorized reseller.
7. Your customers and your sales
- PayAndes has no relationship with your customers. You alone are responsible for your products, prices, deliveries, customer service, warranties, returns, chargebacks and complaints, and for telling your customers your own terms.
- You set up your receiving accounts: Binance Pay ID, wallet addresses, Yape number and exchange rate. Check them carefully: a wrong detail can send a payment to an account that is not yours, and PayAndes cannot recover it.
- The tax, accounting, invoicing and licensing obligations of your business are yours.
8. Crypto payments and verification
- Blockchain transactions are irreversible. PayAndes cannot reverse, cancel or recover transfers.
- Verification depends on information from the networks and from third-party services (Binance, blockchain explorers, Yape). There may be delays, outages or errors outside the control of PayAndes.
- To protect your sales, PayAndes applies rules: exact amount, the time window of each order and a single transaction per order. If a transfer could belong to more than one order, it is held for review and you decide in your dashboard whether to confirm or discard it. That decision and its consequences are yours.
- You and your customers are responsible for using the right network (TRC20 or BEP20), the right address and the exact amount. A transfer on another network, to another address or for another amount may not be verified.
- The value of crypto assets and exchange rates change. PayAndes does not guarantee their price and is not responsible for those changes.
9. Notifications, API and integrations
- When a payment is confirmed, PayAndes notifies your store (IPN notification) and your Telegram. If your store does not respond, the notification is retried, but we cannot guarantee delivery if your server blocks or rejects it.
- Your store, your server, your hosting and their modules are your responsibility: if they block, reject or mishandle a notification, PayAndes is not responsible for orders that are not delivered or are delivered more than once.
- You must keep your integration up to date and protect your API keys.
- Integration modules (for example, the Dhru Fusion module) are provided for use with your account while your plan is active.
10. Your responsibility
PayAndes provides the tool; what you do with it is up to you. In particular, you alone are responsible for:
- the information you register and the settings of your account, your gateways and your integrations;
- the security of your passwords, your email, your Telegram, your devices and the keys of your Binance, wallet and Yape accounts;
- the operations made from your account, even if someone else makes them with your credentials;
- your products, services, prices, deliveries, warranties, returns and customer service;
- complying with the laws of your country and those that apply to your customers: tax, consumer protection, personal data, crypto assets, anti-money-laundering and sanctions;
- getting the permits, licenses or registrations your business needs;
- the data of your customers that your store sends to PayAndes, and having the right to use it;
- reviewing your orders and payments, and keeping your own records and backups;
- what you agree with third parties, including resellers, your suppliers and your hosting provider.
You use the Service at your own risk. PayAndes does not give you financial, legal, accounting or tax advice.
11. Availability and changes to the Service
We work to keep the Service running continuously, but we cannot guarantee that it will never have interruptions or errors. There may be maintenance windows, which we will try to announce in advance.
We may improve, change or remove features. If a change significantly affects the Service you paid for, we will tell you.
12. Intellectual property
The PayAndes brand, its logo, software, design and documentation belong to PayAndes or its licensors. We give you a limited, non-exclusive, non-transferable and revocable license to use the Service while your plan is active.
You keep the rights to your brand and content, you confirm that you have the right to use them, and you allow us to show them on your checkout in order to provide the Service.
13. Personal data
The processing of personal data is governed by our Privacy Policy. For your customers' data, you are the controller and PayAndes acts as a processor: it uses that data only to provide the Service to you and following your instructions.
As the controller, you must tell your customers how you process their data, have a legal basis to do so and handle their requests.
14. Suspension and account closure
You can stop using the Service whenever you want and ask us to close your account.
We may suspend or close an account, with notice when possible, if these Terms are breached, if there are signs of fraud or illegal use, if there is a risk to other users or to the Service, for non-payment or by order of an authority.
When an account is closed, its checkout and API are disabled. We keep only the data the law requires us to keep.
15. No warranties and limitation of liability
To the extent permitted by law, the Service is provided as is and as available, without warranties of any kind. PayAndes does not guarantee that the Service will run without interruptions or errors, nor any result, sales volume or income.
In no event are PayAndes, its owners or its staff liable for:
- losses of money or crypto assets, including those caused by wrong receiving details or by transfers made on another network, to another address or for another amount;
- access to your account or your receiving accounts with your own credentials, or through security failures in your devices, your email or your hosting;
- fraud, scams, chargebacks or claims from your customers or third parties;
- failures, changes, blocks or decisions of third parties, such as Binance, blockchain networks, Yape, Telegram, Google or your hosting provider, including the blocking or closure of your accounts on those services;
- changes in the price of crypto assets or in exchange rates;
- fines, penalties, taxes or claims from authorities related to your business;
- lost profits, loss of customers, data or reputation, or any indirect, incidental or consequential damages.
If, despite the above, PayAndes is found liable, its total liability is limited to the amount you paid for the Service in the 12 months before the event that gives rise to it. Nothing above limits rights that the law does not allow to be limited.
16. Indemnity
You agree to defend and hold harmless PayAndes, its owners and its staff from any claim, damage, fine, penalty, cost or expense, including attorney fees, arising from your use of the Service, your sales, your products, the information you send, a breach of these Terms or of the law, or the violation of third-party rights.
17. Changes to these Terms
We may update these Terms. We will publish the new version with its date and, if the changes are significant, we will tell you through the dashboard, by email or on Telegram at least 15 days in advance. If you keep using the Service after that date, you accept the new version.
18. Governing law and claims
These Terms are governed by the laws of the Republic of Peru. Before starting any claim, write to us at codegsm.peru@gmail.com so we can look for a direct solution for 30 days. If it is not resolved, the parties submit to the judges and courts of Lima, Peru, unless the consumer protection law that applies to you provides otherwise.
